Section E. Decision on the lawfulness of deprivation of liberty
Countless pieces of domestic legislation contain provisions on the right to have the lawfulness of detention reviewed by a court and the release ordered in case it is not lawful (so-called writ of habeas corpus). For instance, the Russian Federation’s Constitution (1993) provides: “Arrest, detention and keeping in custody shall be allowed only by an order of a court of law. No person may be detained for more than 48 hours without an order of a court of law including the right to make a representation against the order of arrest.”
