Practice Relating to Rule 153. Command Responsibility for Failure to Prevent, Punish or Report War Crimes
Georgia’s Criminal Code (1999), taking into account amendments up to 2017, states:
CHAPTER XLVII – Crime against Humanity, Peace and Security and against … International Humanitarian Law
For the crimes provided for by this Chapter, the commander of the armed forces involved in the armed conflict, or the commander of their subunits shall incur liability under this Chapter even when the above crime has been committed by the armed forces subordinated to the management and/or control of the commander, and the crime was caused by inactivity of the commander and/or of any other relevant superior.
