Practice Relating to Rule 108. Mercenaries
At the CDDH, Mauritania expressed “the greatest reservation with regard to the definition, motivation and scope” of mercenary activity as set forth in paragraphs 2(a)–(c) of Article 42 quater
of the draft Additional Protocol I (now Article 47). It explained that “the mercenary of today is no longer motivated solely by the desire for private gain” and, as a result, considered that “the definition and motivations of the mercenary as specified in Article 42 quater
, paragraph 2, are incomplete in so far as their range does not cover all categories of mercenaries”.
