Practice Relating to Rule 160. Statutes of Limitation
The Central African Republic’s Penal Code (2010) states: “Public and civil action, as well as the sentences imparted for [genocide, crimes against humanity and war crimes] are not subject to statutes of limitations.”
The Central African Republic’s Penal Procedure Code (2010) states that “the crime of genocide, war crimes and crimes against humanity are not subject to statutes of limitation.”
The Code also states:
Civil action before criminal courts cannot be engaged after the extinction of the limitation period for public prosecution.
…
Nevertheless the non-applicability of statutory limitations to war crimes applies equally to public prosecution and to civil action resulting from these crimes.
