Practice Relating to Rule 52. Pillage
Senegal’s Disciplinary Regulations (1990) states that, under the laws and customs of war, pillage is forbidden.
Senegal’s IHL Manual (1999) specifies that “every individual is entitled to respect for the minimum universal rules … which prohibit … pillage”.
Senegal’s Penal Code (1965), as amended, punishes pillage and damage to commodities, goods or belongings committed by soldiers as a group.
The Penal Code, as amended in 2007, also states that the following constitute war crimes:
b) [O]ther serious violations of the laws and customs applicable in international armed conflict, within the established framework of international law, namely, any of the following acts:
…
14. pillaging a town or place, even when taken by assault;
…
d) …
Other serious violations of the laws and customs applicable in armed conflicts not of an international character, within the established framework of international law, namely, any of the following acts:
…
5. pillaging a town or place, even when taken by assault.
