Practice Relating to Rule 99. Deprivation of Liberty
Morocco’s Penal Code (1962) provides:
Article 225
Any magistrate, public official, agent or holder of public authority or power who orders or commits any arbitrary act attacking either the individual liberty or civil rights of one or more citizens, is punished with the loss of his civil rights.
If he justifies his act by an order of his hierarchical superiors in an area of their competence, for which he owed them obedience, he benefits from an absolving excuse. In that case, the penalty is only applied to the superiors who have given the order.

Morocco’s Penal Code (1962) provides:
Article 228
Any supervisor or guard of a penitentiary institution or a place allocated to the holding of detainees who has received a prisoner without one of the regular titles of detention provided for in article 653 of the criminal procedure code or who has refused, without showing a prohibition by the investigating magistrate, to present that prisoner to the authorities or persons authorized to visit him, according to the provisions of articles 660 to 662 of the criminal procedure code, or has refused to present his register to the authorized persons mentioned, is guilty of arbitrary detention and punished by imprisonment for 6 months to two years and a fine of 200 to 500 dirhams.

Morocco’s Constitution (1996) provides: “No one shall be arrested, put into custody or penalized except under the circumstances and procedures prescribed by law.”

Morocco’s Penal Code (1962) provides:
Article 227
Public officials, agents of public power, holders of public authority and those responsible for the administrative or judicial police, who have refused or neglected to defer to a reclamation aimed at determining an unlawful or arbitrary detention, either in the institutions or places allocated to the holding of detainees, or anywhere else, and who do not show that they have informed the superior authority of it, are punished with the loss of their civil rights.
