Summary
On 20 June 2014, the Federal Assembly of the Swiss Confederation adopted a law on the protection of cultural property in the event of armed conflict, natural disaster or emergency leading to a complete revision of the Federal Law of 6 October 1966 on the Protection of Cultural Property in the Event of Armed Conflict.
This new law expands the scope of the protection by including protection of cultural property in situations of natural disaster or emergency. The federal law implements the Second Protocol to the Hague Convention of 1954 for the Protection of Cultural Property in the Event of Armed Conflict, notably by providing for a “safe heaven” in its section 6, for movable cultural property when such property is threatened on the territory of the State on which it is located. Pursuant to Article 8 of the law, it will be possible to file applications to UNESCO to obtain “enhanced protection” for cultural property of national importance.
