On 4 October 1958, the Constitution of the French Vth Republic is promulgated.
Its Preamble refers explicitly to three other fundamental texts: the Declaration of Human Rights of 26th August 1789, the Preamble of the Constitution of 27 October 1946 and the 2004 Environment Carta.

Its article 53-2 provides that the Republic can recognize the jurisdiction of the International Criminal Court in accordance with the Rome Statute.

Its article 55 provides that treaties, once ratified, prevail over national laws.
